DUNLOP TYRES MANUFACTURING WARRANTY POLICY (MALAYSIA)
EVERY EFFORT IS MADE BY TOYOTSU BINTER MALAYSIA SDN BHD 202501054067 (1655473-V) (HEREINAFTER REFERRED TO AS “TBMY”), BEING THE AUTHORISED DISTRIBUTOR OF DUNLOP TYRES IN MALAYSIA, TO ENSURE THAT ALL TYRES SUPPLIED MEET THE HIGHEST STANDARDS OF QUALITY IN BOTH MATERIALS AND WORKMANSHIP.
SUBJECT TO THE TERMS AND CONDITIONS SET OUT HEREIN, TBMY WARRANTS THAT DUNLOP TYRES SUPPLIED TO CUSTOMERS IN MALAYSIA ARE FREE FROM MANUFACTURING DEFECTS IN MATERIALS AND WORKMANSHIP WHICH MAY CAUSE THE TYRE TO FAIL PRIOR TO THE COMPLETION OF ITS EXPECTED SERVICE LIFE.
FOR THE PURPOSES OF THIS WARRANTY POLICY, “CUSTOMER” REFERS TO THE ORIGINAL PURCHASER OR USER OF DUNLOP TYRES PURCHASED WITHIN MALAYSIA.
1. PRODUCT COVERAGE AND TERRITORY
1.1 This Warranty Policy applies to Dunlop Passenger Car Tyres, SUV, and 4×4 Tyres (collectively referred to as the “Tyres”), provided that such Tyres are used under normal operating conditions and maintained in accordance with the vehicle manufacturer’s recommendations and Dunlop safety guidelines.
1.2 This Warranty Policy shall apply only to Tyres purchased and used within Malaysia.
1.3 Proof of purchase from an authorised Dunlop dealer or retailer in Malaysia must be presented for any warranty claim.
2. CONDITIONS AND EXCLUSIONS This Warranty Policy covers manufacturing defects only and shall not apply to tyre damage or failure arising from circumstances beyond the control of TBMY, including but not limited to the following:
2.1 Damage caused by external factors or road hazards including punctures, cuts, snags, impact breaks, sidewall damage, bead damage, bruising or rupture resulting from contact with sharp objects, curbs or road debris.
2.2 Damage arising from improper installation, incorrect mounting or demounting, wheel imbalance, or the use of incompatible rims, valves or wheels.
2.3 Damage resulting from vehicle mechanical irregularities including wheel misalignment, suspension defects, axle misalignment or braking system defects that may cause irregular tyre wear.
2.4 Damage caused by improper inflation including under-inflation or over-inflation contrary to recommended tyre pressure.
2.5 Damage resulting from overloading of the vehicle beyond the load capacity specified by the vehicle manufacturer or the load index indicated on the tyre sidewall.
2.6 Tyres that have been repaired, retreaded, modified or altered outside Dunlop’s recommended procedures.
2.7 Damage arising from improper storage conditions including exposure to excessive heat, chemicals, sunlight or unsuitable storage practices.
2.8 Damage caused by accidents, collisions, fire, natural disasters or other force majeure events beyond the reasonable control of TBMY or Dunlop. For the avoidance of doubt, normal wear and tear resulting from regular usage shall not constitute a manufacturing defect.
3. WARRANTY PERIOD
3.1 Passenger Car, SUV, and 4×4 Tyres, manufactured under the Dunlop brand shall be covered for a period of five (5) years from the date of purchase invoice on manufacturing warranty against defects in materials and workmanship, subject to remaining usable tread depth.
3.2 The tyre manufacturing date is indicated on the tyre sidewall within the DOT code, represented by the final four digits indicating the week and year of production.
3.3 All warranty claims must be supported by a valid purchase receipt or invoice issued by an authorised Dunlop dealer or retailer in Malaysia.
4. WARRANTY CLAIM AND ADJUSTMENT
4.1 All tyres submitted for warranty claims must be inspected by TBMY. The determination made following such inspection shall be final and binding.
4.2 Where a tyre is determined to have failed due to a manufacturing defect, compensation may be provided on a pro-rated basis based on the remaining usable tread depth (“RTD”).
4.3 Usable tread depth shall be calculated based on the original tread depth down to the tread wear indicator level of one point six millimetres (1.6mm).
4.4 The pro-rated compensation value shall be calculated as follows: Remaining Tread Depth Original Tread Depth × Value of Tyre Compensation Value= Where: (a) Remaining Tread Depth refers to the measured tread depth of the tyre at the time of inspection, less the tread wear indicator level of 1.6mm; (b) Original Tread Depth refers to the tread depth of the tyre when new, as specified by Dunlop; (c) Value of Tyre refers to the price paid by the Customer for the tyre, as evidenced by the purchase invoice issued by an authorised Dunlop dealer in Malaysia.
4.5 Tyres submitted for inspection shall remain the property of the Customer during the evaluation process. Upon acceptance of a claim and issuance of an adjustment, ownership of the tyre shall transfer to TBMY.
4.6 This Warranty Policy does not cover incidental or consequential expenses including but not limited to mounting, balancing, wheel alignment, transportation, travel expenses, loss of use of vehicle, loss of time, or any loss of business or revenue.
5. GENERAL TERMS
5.1 This Warranty Policy shall be governed by and construed in accordance with the laws of Malaysia. The parties hereby submit to the exclusive jurisdiction of the courts of Malaysia.
5.2 Except as expressly provided herein, TBMY make no other warranties, guarantees or representations, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.
5.3 To the extent permitted by law, TBMY shall not be liable for any indirect, consequential or economic losses including but not limited to loss of profits, loss of business, loss of goodwill or similar losses arising from the use of the tyres.
5.4 If any provision of this Warranty Policy is determined by a court or competent authority to be invalid or unenforceable, such determination shall not affect the validity and enforceability of the remaining provisions of this Warranty Policy. Important Safety Recommendation: For safety reasons, tyres that are more than ten (10) years from the manufacturing date should be replaced with new tyres regardless of remaining tread depth.
